​ROLLING ROCK HUNT

LIABILITY WAIVER

In consideration for the participation in Equine Activities or other activities of whatever kind, whether mounted or unmounted with ROLLING ROCK HUNT (“RRH”), the undersigned, for himself or herself, his or her heirs, successors, and assigns (“RELEASOR”), hereby remises, releases, holds harmless, and forever discharges RRH, and the owners, lessees, lessors, or licenses of the properties on which RELEASOR is present, and all of their respective past, present, and future owners, directors, trustees, officers, managers, supervisors, employees, agents, representatives, partners and their predecessors, successors and assigns, (“RELEASEES”), from any and all claims, damages, injuries, demands, actions, debts, complaints or causes of actions, of whatever kind or nature, at law or in equity (“Claims”), whether known or unknown, asserted or unasserted, that RELEASOR (and any minor participant on whose behalf RELEASOR has signed this Release) had, has, or hereafter can, shall or may have against any or all of the RELEASEES, for, upon, or by reason of any cause, matter, thing or event whatsoever occurring at any time arising from, upon, or by reason of any activity with RRH, whether or not stemming from the negligence of any or all of the RELEASEES or any other individual or entity, including but not limited to trail rides, hound exercises, fox hunts, hunter paces, hunter trials, joint meets, spectating, observing, or any other activity relating to horses, or participating as a rider or spectator in such activities or the additional activities described in 4 P.S. § 602(b) (collectively, “Equine Activities”). RELEASOR covenants and agrees not to sue any of the RELEASEES for any Claims of any kind whatsoever.

​RELEASOR understands and acknowledges that the Claims being released include, but are not limited to, any Claim based on contract or in tort or common law, including those relating to serious injury, death, survivorship, and/or property damage, and/or death to horses, spectators and others.

By signing this Release, the RELEASOR binds himself or herself, as well as his or her heirs, personal representatives, successors and assigns, and if this Release is signed by a Parent or guardian of a minor participant, this Release binds that minor participant and his or her heirs, personal representatives, successors and assigns.

RELEASOR understands and acknowledges that this Release is intended to be as broad and inclusive as permitted by the law of the Commonwealth of Pennsylvania and if any part hereof is held invalid, it is agreed that the balance hereof shall continue in full force and effect.

WARNING

YOU ASSUME THE RISK OF EQUINE ACTIVITIES PURSUANT TO PENNSYLVANIA LAW.

 UNDER PENNSYLVANIA LAW, AN EQUINE ACTIVITY SPONSOR OR EQUINE PROFESSIONAL IS NOT LIABILE FOR AN INJURY TO OR THE DEATHS OF A PARTICIPANT IN EQUINE ACTIVITIES RESULTING FROM THE INHERENT RISKS OF EQUINE ACTIVITIES, AS SET FORTH IN PENNSYLVANIA’S EQUINE ACTIVITY ACT, P.S. §§601-607.

RELEASOR UNDERSTANDS BY SIGNING THIS RELEASE, HE OR SHE WAIVES ALL CLAIMS HE OR SHE EVER HAD, NOW HAS OR MAY HAVE IN THE FUTURE AGAINST ANY OF THE RELEASEES.

 RELEASOR FURTHER UNDERSTANDS BY SIGNING THIS RELEASE, HE OR SHE CONFIRMS THEY HAVE READ THE FOREGOING, UNDERSTANDS IT, AND AGREES TO BE BOUND TO IT AS A CONDITION OF PARTICIPATION IN EQUESTRIAN ACTIVITIES AND/OR OTHER ACTIVITIES OF WHATEVER KIND, WHETHER MOUNTED OR UNMOUNTED WITH RRH.
